H.     Discussion and possible action regarding performance bonds  A presentation was made by staff regarding the issuance and extension of improvement bonds.  After considerable discussion, a motion was made recommending to the Board of County Commissioners that any improvement bond extension be at the amount of present day costs of the improvements being bonded.  Passed 4 yeas, 1 abstention  (Plotkin)

IV.       PUBLIC INPUT – Comments by the General Public and Discussion – No action may be taken

            upon a matter raised under this item of the agenda until the matter itself has been included on

            the agenda. Public comment will be limited to three (3) minutes.

1.         DR-1133-08 - POST RAINBOW, LLC:

HOLDOVER DESIGN REVIEW for a distribution center in conjunction with an approved office/warehouse complex on a portion of 10.3 acres in an M-D (Designed Manufacturing) (AE-60) Zone in the CMA Design Overlay District. 

WAIVERS OF CONDITIONS of a zone change (ZC-0912-07) requiring the following: 1) per elevations submitted on file for all sides on the buildings; and 2) height deviations on Building #5 should be increased to 3 feet.  Generally located on the north side of Post Road, 285 feet west of Rainbow Boulevard within Spring Valley. Approved with staff recomendations

 

2.         DR-0031-09 – M AND M RAINBOW CENTER LLC:

DESIGN REVIEW for a modification to a comprehensive sign package in conjunction with an office and retail center on 2.1 acres in a C-2 (General Commercial) (AE-60) Zone in the CMA Design Overlay District.  Generally located on the west side of Rainbow Boulevard, 300 feet north of Patrick Lane within Spring Valley.  Approved with staff recommendations

USE PERMIT SECOND EXTENSION OF TIME to review a massage establishment within a shopping center on 1.8 acres in a C-1 (Local Business) Zone.  Generally located on the northwest corner of Decatur Boulevard and Pioneer Avenue within Spring Valley.  Approved with staff recommendations

 

4.         UC-0070-07 (ET-0009-09) – park, do h. et al:

USE PERMIT FIRST EXTENSION OF TIME to review a massage establishment within a shopping center on 1.8 acres in a C-2 (General Commercial) Zone.  Generally located on the north side of Spring Mountain Road, 300 feet west of Decatur Boulevard within Spring Valley.  Approved with staff recommendations

 

5.         WS-1631-06 (ET-0011-09) – pham, jim AND mary trust et al:

WAIVERS OF DEVELOPMENT STANDARDS FIRST EXTENSION OF TIME to commence the following: 1) reduce the minimum lot size; and 2) reduce the minimum intersection off-set in conjunction with a proposed residential subdivision on 2.5 acres in an R-E (Rural Estates Residential) (AE-65) Zone in the CMA Design Overlay District.  Generally located on the northeast corner of Post Road and Red Rock Street (alignment) within Spring Valley.  Approved 5-0 with staff recommendations

WAIVER OF DEVELOPMENT STANDARDS FIRST EXTENSION OF TIME to commence a reduction in setback for an existing patio cover addition to a single family residence on 0.1 acre in an R-1 (Single Family Residential) Zone.  Generally located on the south side of Walnut Creek Drive, 200 feet east of Honeycomb Drive within Spring Valley.  Approved with staff recommendations

 

7.         SC-0014-09 – building c, llc:

STREET NUMBERING SYSTEM CHANGE to allow an alternative address for a new office building on 3.2 acres in a U-V (Urban Village - Mixed Use) Zone in the MUD-2 and CMA Design Overlay Districts.  Generally located on the southwest corner of Teco Avenue and Seeliger Street within Spring Valley.  Approved with staff recommendations

 

8.         UC-1150-08 – RICHARDSON, WILLIAM R. AND MELLISSA L.:

USE PERMIT for a recreational facility (indoor shooting range).

WAIVERS OF DEVELOPMENT STANDARDS for the following: 1) reduced parking; 2) increase wall height; and 3) reduced number of loading spaces.

DESIGN REVIEW for a recreational facility on 3.2 acres in an M-D (Designed Manufacturing) Zone and M-D (Designed Manufacturing) (AE-60) Zone in the CMA Design Overlay District.  Generally located on the north side of Russell Road, 590 feet west of Decatur Boulevard within Spring Valley.  Item 1 denied, items 2 & 3 approved with staff recommendations.

 

9.         UC-0009-09 – russell crossing, llc:

USE PERMITS for the following: 1) allow on premise consumption of alcohol (service bar); and 2) allow outside dining and drinking in conjunction with an existing restaurant.

DESIGN REVIEW for an outside dining and drinking patio in conjunction with an existing restaurant on 2.6 acres in a C-1 (Local Business) Zone.  Generally located on the west side of Grand Canyon Drive, 420 feet north of Russell Road within Spring Valley. Approved with staff recommendations

 

10.        UC-0013-09 – silver state equity partners:

USE PERMIT for a minor training facility in conjunction with an existing office complex on 3.0 acres in a C-P (Office and Professional) Zone.  Generally located on the west side of Rainbow Boulevard, 275 feet south of Edna Avenue within Spring Valley.  Approved with staff recommendations.

 

11.        VS-0022-09 –helmick, kirk:

VACATE AND ABANDON a portion of right-of-way being Spring Leaf Drive located between Flamingo Road and Starwood Drive in a C-P (Office and Professional) Zone within Spring Valley (description on file).  Approximately 8 residents of the affected area spoke against this item.  Their main concerns where regarding emergency vehicle access and increase traffic at the two remaining entrances to their tract.  This item was denied.

 

12.        VS-0027-09 – SCHMIDT, VANCE AND JANICE:

VACATE AND ABANDON easements of interest to Clark County located at the northeast corner of Tioga Way and Palmyra Avenue in an R-E (Rural Estates Residential) Zone within Spring Valley (description on file).  Approved with staff recommendations.

 

13.        WS-0019-09 – Turner, Mike:

WAIVER OF DEVELOPMENT STANDARDS to increase wall height in conjunction with a single family residence on 0.6 acres in an R-E (Rural Estates Residential) Zone.  Generally located on the north side of Laredo Street, 201 feet west of Torrey Pines Drive within Spring Valley.  Approved.
