      (1) intersections at Durango & Hacienda and Durango & Oquendo  The staff liaison gave an oral report.  At Durango & Hacienda, the developer of the project at the SW corner will be installing the signal on the west leg of the intersection.  I will try to find out from Public Works Staff more about the intersection at Durango & Oquendo

      (2) processing of zoning requests for properties delinquent in paying property taxes.  Staff liaison is awaiting a legal opinion from the District Attorney 

      (3) dissemination of Town Advisory Board recommendations.  Staff liaison stated the TAB recommendations will be given to all PC members as well as BCC members

IV.       PUBLIC INPUT – Comments by the General Public and Discussion – No action may be taken

            upon a matter raised under this item of the agenda until the matter itself has been included on

            the agenda. Public comment will be limited to three (3) minutes.

1.         DR-0165-08 (ET-0045-09) – rhodes ranch gp:

DESIGN REVIEW FIRST EXTENSION OF TIME to commence construction of a 246 unit condominium complex on 10.0 acres in an R-4 (Multiple Family Residential) P-C (Planned Community Overlay) Zone in the Rhodes Ranch Master Planned Community.  Generally located on the south side of Warm Springs Road, 1,200 feet west of Durango Drive within Spring Valley.  The Rhodes representative stated that this is not part of the RRHOA.  Approved 5-0 with staff conditions

 

2.         DR-0414-07 (ET-0050-09) – desert inn winner plaza, llc:

DESIGN REVIEW FIRST EXTENSION OF TIME to commence a residential conversion into an office building on 1.1 acres in a CRT (Commercial Residential Transition) Zone in the Desert Inn Road Transition Corridor Overlay District.  Generally located on the north side of Desert Inn Road, 290 feet east of Torrey Pines Drive within Spring Valley.  Approved 1 year extensions with staff conditions.

 

3.         ZC-1863-04 (ET-0049-09) – desert inn winner plaza, llc:

ZONE CHANGE SECOND EXTENSION OF TIME to reclassify 1.1 acres from R-E (Rural Estates Residential) Zone to CRT (Commercial Residential Transition) Zone for a conversion of an existing single family residence into an office building in the Desert Inn Road Transition Corridor Overlay District.  Generally located on the north side of Desert Inn Road, 290 feet east of Torrey Pines Drive within Spring Valley (description on file).  Approved 1 year extensions with staff conditions.

 

 

4.         ZC-0132-09 – FALLON T AND J FAMILY TRUST 2002, ET AL:

ZONE CHANGE to reclassify 5.3 acres from R-E (Rural Estates Residential) Zone and R-E (Rural Estates Residential) (AE-60) Zone to C-2 (General Commercial) Zone and C-2 (General Commercial) (AE-60) Zone for a shopping center.  Approved 5-0 with staff conditions

 

 

WAIVER OF DEVELOPMENT STANDARDS for off-site improvements (excluding paving).

DESIGN REVIEW for a shopping center including a tavern/restaurant and 3 story office building in the MUD-3 and CMA Design Overlay Districts.  Generally located on the south side of Sunset Road, 300 feet west of Buffalo Drive within Spring Valley (description on file).  Approved 5-0 with staff conditions

 

5.         ZC-0137-09 – 1979 EHRILICH INVESTMENT TRUST:

ZONE CHANGE to reclassify 5.0 acres from R-E (Rural Estates Residential) Zone to C-1 (Local Business) Zone.  Generally located on the south side of Russell Road and the west side of Conquistador Street within Spring Valley (description on file).  Held to 4-14-09 meeting.

6.         UC-0109-09 – FLAMINGO POINTE PARTNERS, LLC:

USE PERMIT for a massage establishment within an existing mixed-use project on 5.5 acres in a U-V (Urban Village - Mixed Use) Zone in the MUD-3 Overlay District.  Generally located on the north side of Flamingo Road, 260 feet west of Fort Apache Road within Spring Valley.  Approved 5-0 with staff conditions

 

7.         UC-0110-09 – RUSSELL, ROBERT AND PEGGY:

USE PERMITS for the following: 1) exceed area for a garage accessory building; and 2) allow a garage accessory building with modified design standards in conjunction with a single family residence on 0.9 acres in an R-E (Rural Estates Residential) Zone.  Generally located on the east side of El Camino Road, 250 feet south of Eldora Avenue within Spring Valley.  Approved 4-0 with staff conditions

 

 

8.         UC-0111-09 – TWIN WIND DEVELOPMENT CORP:

USE PERMITS for the following: 1) a tire sales and installation facility; and 2) reduced separation between a tire sales and installation facility and a residential use within an existing building on 1.3 acres in a C-2 (General Commercial) Zone.  Generally located on the southeast corner of Tropicana Avenue and Red Rock Street within Spring Valley.  This proposed tire shop was within 50 ft. of condo buildings.  I think the condos are in a “transitional” state and placing the noise, etc. of a tire installation shop so close would further deteriorate the neighborhood.  I made a motion to deny, which resulted in a ties 2-2 vote.  This item will go to the PC with no recommendation.

 

9.         WS-0133-09 – Hemendra, Kalia AND Asha:

WAIVER OF DEVELOPMENT STANDARDS to reduce the rear setback for an addition to a single family residence on approximately 0.5 acres in an R-E (Rural Estates Residential) Zone.  Generally located on the southwest corner of Mann Street and Coley Avenue within Spring Valley.  Approved 4-0 with staff conditions
