The agenda was modified to accommodate the 80+ people in attendance on Item 4 of Attachment A. Item 4 was taken up at this time with Chair Dee Gatliff presiding.

4. ZC-0613-10 – MULTIPLE PROPERTY OWNERS:

ZONE CHANGE to reclassify portions of Sections 9 thru 13 generally located between Cimarron Road and Decatur Boulevard, and between Spring Mountain Road and Sahara Avenue within Spring Valley from R-E (Rural Estates Residential) Zone to R-E (Rural Estates Residential) (RNP-I) Zone to establish a Residential Neighborhood Preservation Overlay District (description on file).  sb/LB/al/xx

 

Several persons expressed general concerns about the ramifications of the proposed RNP1 overlay on matters such as taxes, street requirements, lighting and sidewalks. Staff and others in attendance explained the protections of RNP1 and its limitations and no further concerns were expressed. There was no individual in attendance who opposed the proposal. TAB members advised those attending that the BCC may modify this proposal based on any individual parcel owner requests and urged all to also attend the BCC. TAB approved 5-0

F.      Elect Chair and Vice Chair

The TAB elected Angie Heath-Younce as Chair (5-0) and Duane Laible as Vice-Chair (4-1). New member John Getter was welcomed. Ms. Heath-Younce assumed the duties of Chair at this time.

 

IV.       PUBLIC INPUT – Comments by the General Public and Discussion – No action may be taken upon a matter raised under this item of the agenda until the matter itself has been included on the agenda. Public comment will be limited to three (3) minutes.

02/01/11 PC

 

1.         UC-1067-08 (ET-0214-10) – HANY BOTROS:

USE PERMITS FIRST EXTENSION OF TIME to commence the following: 1) reduce the separation between outside dining and residential development; and 2) eliminate the required pedestrian access around the perimeter of the outside dining area on 0.7 acres in a C-2 (General Commercial) Zone.  Generally located on the south side of Flamingo Road, 500 feet east of Rainbow Boulevard within Spring Valley.  SB/al/ml

TAB asked about any existing Design Reviews for lighting and signage. Applicant advised there were no lighting or signage changes planned for this item. TAB approved with staff recommendations 5-1.

 

2.         WS-0528-10 – IN-N-OUT BURGERS:

WAIVER OF DEVELOPMENT STANDARDS to increase wall height in conjunction with a previously approved warehouse and distribution center.

DESIGN REVIEW for a decorative wall on 2.4 acres in an M-D (Designed Manufacturing) (AE-60) Zone in the CMA Design Overlay District.  Generally located on the east side of Montessouri Street, 160 feet north of Sunset Road within Spring Valley.  SS/pd/ml

TAB Approved 5-0 with staff conditions

 

3.         WS-0564-10 – PAREDES, CARMEN M.:

WAIVERS OF DEVELOPMENT STANDARDS for the following: 1) reduced rear yard setback; and 2) allow a flat roof without a parapet in conjunction with an addition to an existing single family residence on 0.2 acres in an R-1 (Single Family Residential) Zone.  Generally located on the north side of Spring Meadow Drive, 475 feet east of Torrey Pines Drive within Spring Valley.  SB/mc/ml

Asked to respond to staff objections and recommendation of denial, applicant gave no apparent substantive reasons for seeking the waivers other than personal preference. TAB members discussed the plans and comments agreed with the staff objections that this proposal would be out of character with the surrounding neighborhood. TAB denied 5-0.
