1A.       UC-0138-11MADRAS DURANGO, LLC:

USE PERMITS for the following: 1) a convenience store; 2) reduce the separation from a convenience store to a residential use; 3) a service station; 4) reduce the setback from a service station to a residential use; and 5) a car wash.

WAIVER OF DEVELOPMENT STANDARDS to allow modified driveway design standards.

DESIGN REVIEW for a commercial development consisting of an office and retail building, convenience store, service station, and car wash on 1.4 acres in a C-1 (Local Business) Zone in the CMA Design Overlay District.  Generally located on the east side of Durango Drive, 150 feet north of Robindale Road within Spring Valley.  SS/dg/ml Held until 6/4. USE PERMITS FIRST EXTENSION OF TIME to review the following: 1) a tire sales and installation facility within an existing building; and 2) reduced separation between a tire sales and installation facility and a residential use on 1.3 acres in a C-2 (General Commercial) Zone.  Generally located on the southeast corner of Tropicana Avenue and Red Rock Street within Spring Valley. Approved 4-0. TAB added a 2 year time limit with all other staff conditions

 

2.         UC-0149-11 – GARY MCDANIEL L & V 1991 LIVING TRUST, ET AL:

USE PERMIT to allow an accessory structure (garage) without a principal use or structure on 0.4 acres in an R-E (Rural Estates Residential) Zone in the MUD-3 Overlay District.  Generally located on the north side of Laredo Street, 135 feet east of Belcastro Street within Spring Valley.  LB/mc/ml

Denied 4-0 per staff recommendations. There is no plan for the property and the proposed change to a de facto storage facility is inappropriate as presented.

 

3.         WS-0141-11 – PETERSON, SCOTT E.:

WAIVERS OF DEVELOPMENT STANDARDS for the following: 1) reduce the side street (corner) setback; 2) reduce the setback from a right-of-way; and 3) increase the height for an accessory structure (casita) in conjunction with an existing single family residence on 0.5 acres in an R-2 (Medium Density Residential) Zone.  Generally located on the north side of Phoenician Avenue and the east side of Camelot Cove Street within Spring Valley.  sb/pb/ml

4.         WS-0164-11 – SO. RAINBOW CAP LLC:

WAIVERS OF DEVELOPMENT STANDARDS for the following: 1) increase the height of a freestanding sign; and 2) reduce the separation between freestanding signs.

DESIGN REVIEW for a freestanding sign in conjunction with an existing restaurant on 0.8 acres in a C-2 (General Commercial) Zone in the MUD-3 and CMA Design Overlay Districts.  Generally located on the west side of Rainbow Boulevard, 500 feet south of Arby Avenue within Spring Valley.  ss/pb/xx

Denied 4-0 per staff recommendations. Applicants stated justifications were designed to overcome claimed problems apparently created by the applicant’s previous decisions. Most stated issues by applicant are matters best negotiated with the landowner.

 

F.      Receive a report from Nancy Lipski, Director, Clark County Comprehensive Planning, on Application Time Limits, Commencement and Studies.

Ms. Lipski presented her thoughts on various options to enhance the planning process, especially the time limits imposed at various stages of development. The consensus of the TAB inputs appeared to support the concept of tightening procedures to support legitimate development while dis-incentivizing applications designed to support “flipping” transactions. The TAB asked the department to provide any additional tools available to support sound common sense recommendations. Ms. Lipski committed to a follow-up session with the TAB when plans are more complete.
