being sought about the weight attached to a TAB recommendation if only three
members are present and there is a 2-1 vote.

DESIGN REVIEW to construct a decorative perimeter fence around an existing public
facility (Desert Breeze Soccer Park Complex) on 40.0 acres in a P-F (Public
Facility) Zone. Generally
located on the northeast corner of Durango Drive and Spring Mountain Road

Approved 4-0 with additional conditions: All gates must allow both
ingress and egress, and there should be a maximum number of gates to allow for
easy pedestrian access.
There was
considerable discussion of the item involving both citizens and TAB members.
The plan was presented as an effort to protect the park grounds, especially in
the wake of a rainstorm. Some citizens complained about making access more
difficult. TAB pointed out there was not even a gate directly available at the
crosswalk from designated parking areas at Desert Breeze. But, the most
questions were raised about the wisdom of spending funds to fence a public park
at a time when austerity is causing job losses and service cuts. The TAB
concluded it was asked to advise on the design alone and
deferred spending recommendations to the staff and the

The applicant
first asked that a vote be taken despite the total lack of inputs and
information from Public Works. TAB members expressed empathy with his desire,
but stated they could not make a recommendation without the critical
information. We apologized that our responsibility to the PC,

requiring the following: 1) install a 5 foot wide landscape
strip outside the wall; and 2)
install curb and gutter in conjunction with a proposed accessory use and
accessory structures on 2.5 acres in an
R-E (Rural Estates Residential) (RNP-I) (AE-65) Zone in the

Her request was to be able to improve her property in harmony with her
neighbors. She further asked that rural standards for offsites
remain the standard in the RNP. Several neighbors expressed support for the
request. The staff report was not provided until the item was being presented.
It was the first time the applicant had learned the staff recommended denial of
her application and the additional request to maintain rural standards in the
rural area. TAB members expressed concerns about the timeliness of the staff
report and the recommendation to impose non-standard conditions within an RNP. They
also concluded the “if approved” conditions did not properly protect and
respect the RNP and recommend rural standards be applied.
9. WS-0286-12 – DDMI PROPERTIES,
LLC:
WAIVER OF DEVELOPMENT STANDARDS to reduce setbacks for an
existing addition (garage) to a single family dwelling on 0.5
acres in an R-E (Rural Estates Residential) (RNP-I) Zone. Generally
located 150 feet north of Eldora Avenue, and 150 feet east of Buffalo Drive

3-1 with staff conditions. There was no opposition presented to this application. The
applicant admitted his violations of permitting requirements that led to his
open CCPRO case. There was reason to believe the CCPRO complaint may be the
result of a neighbor dispute, although no neighbors appeared. The majority
concluded it is appropriate to allow the finished garage to stand. The single vote
against was based on a consistent belief by a member that setbacks should not
be reduced.
