V.        TOWN BOARD INPUT – John Getter complimented the design and appearance of the new park at Tropicana and Decatur. It is open and already getting a lot of use.

1A.      UC-0612-10 (ET-0107-12) – BHODHIYANA MEDITATION CENTER TRUST:

USE PERMIT SECOND EXTENSION OF TIME to complete a block wall in conjunction with a place of worship on 1.0 acre in an R-E (Rural Estates Residential) Zone.  Generally located on the east side of Westwind Road, 100 feet north of Doe Avenue within the Spring Valley Planning Area.  SB/mc/ml  (For possible action)

No one from neighborhood appeared to oppose. Approved 5-0 with staff conditions

1.         UC-0546-12STICKNEY, LEE A. & MARLENE A.:

USE PERMIT to allow 3 employees with a home occupation in conjunction with a single family residence on 0.2 acres in an R-1 (Single Family Residential) Zone in the CMA Design Overlay District.  Generally located on the southwest corner of Vista Cantera Court and Bonita Vista Street within Spring Valley.  SS/bk/ml  (For possible action)

Denied 5-0 per staff recommendation

“Petitions” were presented indicating 8 households opposed and 6 approve. Five neighbors appeared in opposition and one appeared in favor of the application. Applicant’s justifications were a moving target. He stated that to not approve would mean he would terminate 3 employees and go out of business. Business is all done by phone and web, but he does not consider telecommuting an option. Property was purchased as an investment. The applicant lives next door and said he would live upstairs at this location to maintain its residential status, but had no plans to bring the property to appropriate commercial occupancy standards. TAB discussed and agreed with the staff position that this would amount to an “… attempt to have an office use within a residence to circumvent the purpose of office and commercial zoning districts.”

 

2.         VS-0563-12 – RHODES RANCH, GP:

VACATE AND ABANDON a portion of right-of-way being Seeliger Street located between Wigwam Avenue (alignment) and Ford Avenue (alignment) and a portion of right-of-way being Wigwam Avenue located between Hidden Mountain Way and El Capitan Way (alignment) in an R-E (Rural Estates Residential) Zone and an R-2 (Medium Density Residential) P-C (Planned Community Overlay District) Zone within Enterprise and Spring Valley (description on file).  SB/rk/xx  (For possible action)

4.         WT-0562-12 – RHODES RANCH, GP:

WAIVER for non-standard street improvements for Seeliger Street in an R-2 (Medium Density Residential) P-C (Planned Community Overlay District) Zone in Rhodes Ranch Master Planned Community.  Generally located 390 feet south of Augusta Course Avenue and 1,250 feet east of Hidden Mountain Way within Spring Valley.  SB/rk/ml  (For possible action)

            Approved 5-0 as requested by applicant with 48 feet wide public street, with staff conditions

 

3.         VS-0569-12 – MAVERIK, INC:

VACATE AND ABANDON easements of interest to Clark County located between Russell Road and Quail Avenue (alignment), and between Jones Boulevard and Bronco Street (alignment), and a portion of right-of-way being Russell Road located between Jones Boulevard and Bronco Street (alignment), and Jones Boulevard between Russell Road and Quail Avenue (alignment) in a C-1 (Local Business) (AE-60) Zone in the CMA Design Overlay District within Spring Valley (description on file).  SS/dg/xx  (For possible action)

Approved 5-0 with staff conditions. Applicant confirmed this action in no way alters the conditions in the original approval agreed to in neighborhood meetings.
