BOARD INPUT – John Getter complimented the design
and appearance of the new park at Tropicana and Decatur. It is open and already
getting a lot of use.

“Petitions”
were presented indicating 8 households opposed and 6 approve. Five neighbors
appeared in opposition and one appeared in favor of the application. Applicant’s
justifications were a moving target. He stated that to not approve would mean
he would terminate 3 employees and go out of business. Business is all done by
phone and web, but he does not consider telecommuting an option. Property was
purchased as an investment. The applicant lives next door and said he would
live upstairs at this location to maintain its residential status, but had no
plans to bring the property to appropriate commercial occupancy standards. TAB
discussed and agreed with the staff position that this would amount to an “… attempt to have an office use within a residence to
circumvent the purpose of office and commercial zoning districts.”
