ZONING AGENDA

 

12/18/12 PC

 

1.         DR-0989-08 (ET-0135-12) – Agusta Associates, LP:

DESIGN REVIEW SECOND EXTENSION OF TIME to commence an apartment complex on 10.6 acres in an R-3 (Multiple Family Residential) Zone.  Generally located on the north side of Sunset Road, 1,000 feet west of Fort Apache Road within Spring Valley.  SB/co/ml  (For possible action)

Approved 5-0 with staff conditions

 

2.         NZC-0633-12 – HDL INVESTMENTS, LLC, ET AL:

ZONE CHANGE to reclassify 17.2 acres from R-E (Rural Estates Residential) Zone, R-E (Rural Estates Residential) (AE-60) Zone, and C-2 (General Commercial) Zone to R-4 (Multiple Family Residential - High Density) Zone and R-4 (Multiple Family Residential - High Density) (AE-60) Zone in the MUD-3 and CMA Design Overlay Districts.

DESIGN REVIEWS for the following: 1) a multiple family residential development; 2) signage; and 3) lighting.  Generally located on the north side of Rafael Rivera Way, 350 feet west of Buffalo Drive within Spring Valley (description on file).  SS/dg/ed  (For possible action)

Denied 4-1

The majority denied support based on:

·         Concerns about traffic safety involving Rafael Rivera Way and the project entrance.

·         The applicant also argued for approval based on planned expansion based on additional parcels not owned by the applicant and not part of this item.

·         Timing of the zone change proposal was questioned based on the pending major revision of the Spring Valley Land Use Plan and the TAB concluded this discussion should be included in that process.

·         Owners of abutting BDRP zone expressed serious concerns about the negative impact of placing a residential use so close to industrial operations in place and planned for the future.

·         Six neighbors appeared in opposition and stated they had received notice of only part of this proposal item. They said proposed road abandonment would cause extreme damage to their ability to develop their abutting BDRP property.

·         There was confusion in the proposal about the scope and location of signage.

 For these reasons the majority voted for denial. The member voting for the project stated he felt the area needs more apartments and this was a good project. 

 

3.         UC-0654-12 – DRABZIN INTERNATIONAL, LLC:

USE PERMITS for the following: 1) on-premise consumption of alcohol (service bar); and 2) reduce the separation between an outside dining/drinking area and a residential use in an existing commercial center.  

DESIGN REVIEW for an outside dining area in conjunction with an existing restaurant within an existing commercial center on 0.1 acres in a C-1 (Local Business) Zone.  Generally located on the west side of Durango Drive, 300 feet north of Rochelle Avenue within Spring Valley.  Ss/mk/ml (For possible action)

Approved 5-0 with staff conditions.

Applicant agreed to staff proposed limits on outside use including 1 year review and elimination of proposed outdoor use on the Southeast side of the building.

 

4.         UC-0660-12 – DEHORTY, JOSEPH & G. LIV TR:

USE PERMIT for a minor training facility (after school tutoring for blind children) in conjunction with an office building on 1.3 acres in a CRT (Commercial Residential Transition) Zone.  Generally located on the north side of Martin Avenue, 300 feet east of Fort Apache Road within Spring Valley.  SB/mk/ml (For possible action)

Approved 5-0 with staff conditions

 

5.         VS-0650-12 – friedman, gary & dale m.:

VACATE AND ABANDON easements of interest to Clark County located between Oquendo Road and Ponderosa Way, and between Red Rock Street and Jones Boulevard in an R-E (Rural Estates Residential) (RNP-I) (AE-60) Zone in the CMA Design Overlay District within Spring Valley (description on file).  SS/jt/ed (For possible action)

6.         DR-0648-12 – BHODHIYANA MEDITATION CENTER:

DESIGN REVIEW for a new meditation center in conjunction with an approved place of worship (monastery) on 1.0 acre in an R-E (Rural Estates Residential) Zone.  Generally located on the east side of Westwind Road, 100 feet north of Doe Avenue within the Spring Valley Planning Area.  SB/dg/ml  (For possible action)

Approved 5-0 with staff conditions

Neighbor who had appeared in an earlier iteration to oppose supported this action

 

7.         UC-0664-12 – THE HOWARD HUGHES COMPANY, LLC:

USE PERMIT for a future expansion to a private recreational facility (water park) and to allow a temporary parking lot in conjunction with a private recreational facility.

VARIANCE to allow a temporary parking lot to have a semi-permanent surface instead of asphalt or concrete.

WAIVER to defer full off-site improvements (Maule Avenue) on 41.2 acres in an R-E (Rural Estates Residential) P-C (Planned Community Overlay District) Zone within Village 16A in the Summerlin South Master Planned Community.  Generally located on the south side of Maule Avenue, 1,300 feet west of Fort Apache Road within Summerlin South and the Spring Valley Planning Area.  SB/rk/ml  (For possible action)

Approved 4-1 as requested by applicant

The majority approved the waiver (opposed by staff) based on comments by applicant that this proposal is to test likely expansion of the project in the future. If off-sites are required now, the applicant states they would likely be forced to remove and replace much of those off-sites when current testing is completed in about a year. This would result in a significant cost for little apparent public benefit.

The vote to oppose the waiver was based on a philosophical position against waivers.

 

8.         UC-0666-12 – RHODES RANCH, GP:

USE PERMIT for modified residential development standards in conjunction with a single family subdivision.

WAIVERS for the following: 1) allow modified street improvement standards; and 2) allow final early grading on an 18.1 acre portion of an overall 40.7 acre site in an R-2 (Medium Density Residential) P-C (Planned Community Overlay District) Zone in the Rhodes Ranch Master Planned Community.  Generally located 475 feet east of Hidden Mountain Way, and 700 feet south of Augusta Course Avenue within Spring Valley and Enterprise.  SB/rk/ml  (For possible action)

            Approved 5-0 with staff recommendations
