F.      Discuss Spring Valley Land Use Plan including land use category descriptions, goals and policies, administrative procedures and descriptive land use map in preparation for the 2014 update process. TAB member Getter updated the members on recent NCZ applications and concerns about avoiding “spot zoning” before the upcoming LUP revision. Members of the BCC have expressed similar concerns and have suggested consideration of moving up the schedule for revisions. Developers are working hard to find available land for residential development that is limited due to current planned uses.

 

G.     Discuss/Action:  Discuss whether to allow short term rentals AG-0101-13.

The SVTAB unanimously passed this position statement:

The Spring Valley Town Advisory Board is opposed to changes to regulations or code that would allow for short-term rentals in residential communities as is being considered by the Board of County Commissioners. Previous experiences with such facilities have been universally negative and their existence resulted in damage to our community and the enjoyment and safety of nearby residents.

IV.       COMMENTS BY THE GENERAL PUBLIC – Three individuals who identified themselves as fire inspectors spoke to oppose a plan to reorganize the management of their operations from the fire department to the building department.

V.        TOWN BOARD INPUT – G. Kuck asked that PW give attention to repairs of Durango south of Spring Mountain

1.         DR-0109-13 – SCOPE DURANGO, LLC:

DESIGN REVIEW for a day care facility including playground areas with shaded play structures on a portion of 4.1 acres in a C-1 (Local Business) Zone in the MUD-4 Overlay District.  Generally located on the east side of Durango Drive, 330 feet north of Edna Avenue within Spring Valley.  SB/dg/ml  (For possible action)

Approved 4-0 with staff conditions

 

2.         VS-0105-13 – gallinot family trust, et al:

VACATE AND ABANDON easements of interest to Clark County located between Fort Apache Road and Wind Whisper Street, and between Martin Avenue and Sunset Road in an R-3 (Multiple Family Residential) Zone within Spring Valley (description on file).  SB/mk/ed  (For possible action)

Approved 4-0 with staff conditions

 

3.         WS-0104-13 – GALLINOT FAMILY TRUST; ET AL:

WAIVERS OF DEVELOPMENT STANDARDS for the following: 1) reduced setbacks for garage openings to a drive aisle; and 2) increased building height.

WAIVERS OF CONDITIONS of a zone change (ZC-0150-06) requiring the following: 1) 25 foot stub streets to be marked with “No Parking” signs on both sides of the street, and provide 24 feet of drivable surface; 2) garages facing non-cluster streets to have 20 foot driveways; 3) 25 foot stub streets to access a maximum of 6 lots; and 4) all clusters to be posted with “No Parking” signs.

DESIGN REVIEW for a multiple family residential development (apartments) on 5.1 acres in an R-3 (Multiple Family Residential) Zone.  Generally located on the northwest corner Fort Apache Road and Martin Avenue within Spring Valley.  SB/rk/ml  (For possible action)

4.         DR-0613-08 (ET-0005-13) - digital desert, LLC:

DESIGN REVIEW SECOND EXTENSION OF TIME to commence an office warehouse complex on 19.4 acres in an M-D (Designed Manufacturing) Zone in the MUD-3 and CMA Design Overlay Districts.  Generally located on the northeast corner of Riley Street and Patrick Lane within Spring Valley. SB/jt/ml  (For possible action)

Approved 3-1 with staff conditions. Member J. Getter requested an amendment so extension expiration would be timed to match the new LUP update (19 months instead of 24 months). Request was rejected. This parcel is an example of one deserving reconsideration for residential use and the developer representative acknowledged that might be a positive action.

 

5.         NZC-1364-07 (ET-0006-13) - DIGITAL DESERT, LLC:

ZONE CHANGE SECOND EXTENSION OF TIME to reclassify 19.4 acres from C-1 (Local Business) Zone to M-D (Designed Manufacturing) Zone for an office warehouse complex in the MUD-3 and CMA Design Overlay Districts.  Generally located on the northeast corner of Riley Street and Patrick Lane within Spring Valley (description on file).  SB/jt/ml  (For possible action)

No decision 2-2. A motion for a condition of 19 months as in item 4 split the board.

 

6.         VS-0662-08 (ET-0004-13) – digital desert, llc:

VACATE AND ABANDON SECOND EXTENSION OF TIME a portion of right-of-way being Patrick Lane located between Riley Street and Bonita Vista Street in a C-1 (Local Business) Zone in the MUD-3 and CMA Design Overlay Districts within Spring Valley (description on file).  SB/co/ed  (For possible action)

Approved 4-0 with staff conditions
