DESIGN REVIEW for a temporary gravel pit on a portion of 32.5 acres in a P-F (Public Facility) Zone and an R-E (Rural Estates Residential) Zone.  Generally located on the south side of Chartan Avenue, 100 feet west of Starr Hills Avenue within Enterprise.  SB/mh/dr 

 

The TAB was concerned about the hours of operation for the crushing operation in a residential area.  The applicant has located the crusher as far away from the residences as possible.  The crusher would operate when the construction crew is at work (7:00am to 3:00pm).  PC routine action item agenda item # 10

The Board of County Commissioners’ zoning meeting is now a single session (9:00 am) with a 30 minute break at noon.  The separate morning and afternoon sessions have been eliminated.

 

8.      DR-0530-09 – B D PARCEL HOLDINGS, LLC:

DESIGN REVIEW for a convenience store, service station, and a drive-thru restaurant on 2.2 acres in a C-2 (General Commercial) Zone.

 

WAIVERS OF CONDITIONS of a zone change (ZC-0324-04) requiring the following:

 

1) along Blue Diamond Road, providing a 15 foot wide landscape buffer with medium trees, 24 inch box in size, with shrubs to cover 50% of the landscape area, with a detached sidewalk; and

2) right-of-way dedication to include 40 feet for Arville Street and associated spandrels.

9.      DR-0564-09 – LAS VEGAS MOTORCOACH RESORT ASSOCIATION: Companion item # 5

TAB approved per Current Planning conditions. 

· The applicant must follow all Las Vegas Valley Water District conditions and regulations for water features.

 

DESIGN REVIEW for water features in conjunction with an existing RV park on portions of 5.2 acres in an R-V-P (Recreational Vehicle Park) Zone.  Generally located on the west side of Arville Street, 440 feet south of Windmill Lane within Enterprise.  SS/mh/dr 

 

The plans depict water features within the Las Vegas Motorcoach Resort consisting of 3 ponds and 2 urns.  The 2 urns have the appearance of large pots with water bubbling out of the top and flowing down the sides and are located on both the north and south sides of the clubhouse building within round, catch basins. 

 

The staff does not routinely support approval of water features.  The 3 ponds in this request have already received Administrative Design Review approval to operate due to the removal of turf and payment of fees to the Water District.  The 2 urn water features were never approved for construction through a design review nor approved to operate through the administrative design review process.

 

The TAB opinion is the 2 urns should go through the design review process.  The objective is to operate the urns as long as the water use is offset by removing turf and xeriscape.  One solution is the replacement of the turf around the urns with xeriscape.  The review process at the Las Vegas Water District will insure these urns will not increase the water usage required to operate the property.  BCC agenda item # 39

 

 

 

10.    WS-1515-04 (ET-0255-09) – SCROGGINS, BRIAN:

TAB approved Staff conditions

 

WAIVERS OF DEVELOPMENT STANDARDS SECOND EXTENSION OF TIME to commence the following:

 

1) off-site improvements including partial paving;

2) street landscaping and wall requirements along a collector/arterial street;

3) permit accessory structures (block walls) prior to the principal structure; and

4) permit subdivided lots to face onto and access a collector street

 

on 2.0 acres in an R-E (Rural Estates Residential) (RNP-I) Zone.  Generally located on the west side of Arville Street, 150 feet north of Capovilla Avenue within Enterprise.  SS/mc/dr 

 

The offsite improvements on this application points to an area that needs to be reviewed.  Within Enterprise, there are arterials and collector roads that transect RNP-1 neighborhoods.  In some cases, these roads should be downgraded to local roads.  The combination of UPRR tracks, major roads (I-15 and Clark County 215), Major Projects, and geographic features limit the traffic on these roads.  Arville north of Warm Springs is an example.  It is blocked by CC-215 on the north, there are no plans to bridge CC-215 and the area north of Warm Springs is low density residential.  This road could be developed as a 60 ft local road using Non Urban Road Standards.  BCC routine action item agenda item # 13

 

11.    ZC-0541-09 – MERTON L. AND JACQUELINE SCHWARTZ REVOCABLE TRUST:

ZONE CHANGE to reclassify 3.8 acres from R-E (Rural Estates Residential) Zone to C-1 (Local Business) Zone for future commercial development.  Generally located on the southwest corner of Rainbow Boulevard and Mountains Edge Parkway within Enterprise (description on file).  SB/mh/df  BCC routine action item agenda item # 34

 

 

12.    ZC-0542-09 – ALPER LIMITED PARTNERSHIP:

TAB approved Staff conditions

 

ZONE CHANGE to reclassify 3.5 acres from R-3 (Multiple Family Residential) Zone to C-1 (Local Business) Zone for future commercial development in the MUD-4 Overlay District.  Generally located on the north side of Blue Diamond Road and the west side of Cimarron Road within Enterprise (description on file).  SS/rs/df 

 

The site was previously subdivided into a 50 lot subdivision and planned for R-3 zoned type development as a later phase of Storybook Homes development to the west of this site. Streets were planned and the site was graded for potential residential development which did not materialize. An access easement was reserved by Clark County when the reversion map recorded and this needs to be part of the ultimate development.

 

The TAB concern for this site is fire department access and traffic flow for the R-3 development to the west. The staff position is that access will be reviewed when the design review is submitted for this site.  The question is will the entire area covered by the original Storybook development be reviewed or only the area covered by a new design review?  This is a case where the plan needs to look at neighborhood,  not just the site being developed.  This BCC routine action item agenda item # 35

14.       ZC-0369-03 (ET-0230-09) – BUFFALO-WINDMILL, LLC:

HOLDOVER ZONE CHANGE SECOND EXTENSION OF TIME to reclassify 5.0 acres from R-E (Rural Estates Residential) Zone to C-1 (Local Business) Zone for a shopping center.  Generally located on the southeast corner of Buffalo Drive and Windmill Lane within Enterprise (description on file). SS/dg/dr

The plans submitted with the original application in 2003 depicted a shopping center covering the subject parcel and the 2.4 acre parcel immediately to the east.  However, in 2006, a new design review was approved on the 2.4 acre parcel that consisted of a 30,000 sq ft office center.  The 2.4 acre parcel is under separate ownership and is proceeding separately from this 5 acre parcel even though, overall, the parcels are under the same zone change.  The owners of the 2.4 acre parcel recently submitted an extension of time on this zone change for their portion of the overall development.  Staff recommended removing the time limit since the land use plan designates the property as Commercial Neighborhood, which is consistent with the current C-1 zoning.  However, the Board of County Commissioners considered the item and imposed a 1 year time limit to complete the project. 

 

The ‘extension of time’ is under greater scrutiny by the BCC.  This is resulting in shorter extensions being granted.  The TAB has seen extensions for as long as ten years.  After several years, the question becomes is the original project still viable or is the applicant not examining the project in light of current conditions.  The project above is an example.
