The following items were heard at the Enterprise TAB on September 26, 2007.   The TAB recommendations are below.  The October 2, 2007 PC decisions/recommendations, and October 3 2007 BCC decisions will be posted when available.  Within a week or two you will be able to read the PC and BCC Notice of Final Action on the Clark County web site Agenda page.  Any person who objects to the PC decisions/recommendations may appeal to the BCC within five business days of the date of the hearing.  An appeal may be made in person at the Current Planning desk or by fax.  Call Current Planning or SWAN to find out how.

DISCUSSION ITEM: Budget Items for Enterprise TAB for 2008.

The TAB is seeking public input on projects within Enterprise that can be placed in the Clark County budget request for 2008.  If you have any ideas please send them to SWAN to be forwarded to the TAB at their meeting.

VACATE AND ABANDON easements of interest to Clark County located between Cougar Avenue (alignment) and Wigwam Avenue, and between Rainbow Boulevard and Belcastro Street (alignment), and a portion of a right-of-way being Rainbow Boulevard located between Cougar Avenue (alignment) and Wigwam Avenue in a C-2 (General Commercial) Zone within Enterprise (description on file).

 

Part of this application was a 25 ft x 70 ft drainage easement along the middle of the Rainbow frontage.  This drainage easement was withdrawn from the application. There is a continuing discussion between the county and the applicant about the reimbursement for that easement.  PC agenda item # 26

USE PERMIT to increase the height of an existing communications tower on 2.0 acres in an M-1 (Light Manufacturing) (AE-70) Zone. Generally located on the northeast corner of La Cienega Street (alignment) and Pamalyn Avenue within Enterprise

 

This tower is in the middle of a commercial/ industrial area and does not effect any residential.  The current tower is partially blocked by an 88 ft building resulting in a

class=Section2>

5.         UC-1039-07 — WARM SPRINGS JONES 25 INVESTMENTS, LLC:  TAB Approved.  Use Permit Design review: Denied - variance

 

USE PERMIT for outside dining.

 

VARIANCE to increase architectural building height on approximately 15.0 acres in a C-2 (General Commercial) Zone.

 

DESIGN REVIEW for a shopping center in Pinnacle Peaks Concept Plan area. Generally located on the south side of Warm Springs Road and the east side of Jones Boulevard within Enterprise

The variance associated with this application is due to two architectural towers shown on each end of the corner "L" shaped building at the intersection of Warm Springs Road and Jones Boulevard. The roof of the towers is at 84 feet and the decorative spine is an additional 10 feet for a total of 94 feet. The remaining building design shows the tallest building height at two stories, 50 feet, with the corner building and pad sites shown at one story, 24 feet in height. The applicant indicates the towers’ design will be used to create a noticeable element for the shopping center that will be visible from the Beltway to the north.

 

The TAB opinion is a 94 ft tower does not fit in the area.  PC agenda item # 24

 

6.         VS-1021-07 — SOUTHERN HIGHLANDS DEVELOPMENT CORPORATION: TAB Approved

8.         WS-1019-07 — LAND DEVELOPMENT, INC:   TAB held no applicant

 

WAIVER OF DEVELOPMENT STANDARDS for architectural enclosures on 1.8 acres in an R-2 (Medium Density Residential) Zone in the MUD-3 Overlay District. Generally located on the northwest corner of Camero Avenue and Arville Street within Enterprise  PC agenda item # 29

 

9.         WS-1030-07 — RICHMOND AMERICAN HOMES: TAB Denied

 

WAIVER OF DEVELOPMENT STANDARDS to reduce rear yard setbacks for single family residences in conjunction with a residential subdivision on 15.2 acres in an RUD (Residential Urban Density) Zone. Generally located on the south side of Windmill Lane and the east side of Warbonnet Way within Enterprise.

 

2 of the 7 house plans for this sub-division do not fit on the lots without a waiver reducing the rear setback to 12 ft where 15 is required.  The TAB felt this was too large of a reduction to an already small backyard and the developer had 5 models that could be offered that did not require a waiver.  PC consent agenda item # 21

 

10. WS-1044-07 — CJH DEVELOPMENT, LLC: TAB Held

 

WAIVER OF DEVELOPMENT STANDARDS for a reduced height setback ratio adjacent to a residential use.

 

DESIGN REVIEW for a hotel with all other associated retail, commercial and accessory uses, and a freestanding restaurant on 4.1 acres in an H-1 (Limited Resort and Apartment) Zone in the MUD4 Overlay District. Generally located on southeast corner of Giles Street and Windmill Lane within Enterprise.

 

The applicant had revised the hotel plans based upon discussions with SWAN.  The staff report to the TAB evaluated the old plans.  The TAB did not want to evaluate the project without the correct staff report.  In addition, several neighbors needed to be brought into the discussions.  The TAB held this item until such time as the correct staff write up could be presented and a neighborhood meeting could take place.  PC agenda item # 30

 

11. WT-1040-07 — WARM SPRINGS JONES 25 INVESTMENTS, LLC:  TAB Approved

 

WAIVER for modified street improvement standards in conjunction with a proposed commercial/retail center on approximately 15.0 acres in a C-2 (General Commercial) Zone in the Pinnacle Peaks Concept Plan area. Generally located on the south side of Warm Springs Road and the east side of Jones Boulevard within Enterprise.

 

The plans show a redesign of a shopping center that was approved earlier this year. The main access points to the site will be provided from Warm Springs Road. There are 2 additional access points from Jones Boulevard with one located towards the back of the building which will be dedicated primarily for employee and service needs. The applicant is required to provide a 150 ft long entryway for each ingress/egress point.  However, this waiver is being requested to reduce that requirement to a minimum of 73 feet.  The applicant has worked with civil engineering to meet the traffic requirements for this project.  The 150 ft throat depth for driveways is a new requirement and has resulted in a number of waivers.  PC agenda item # 25

DESIGN REVIEW for an office building, storage building, and contractor's storage yard.

 

            WAIVER OF CONDITIONS of a zone change (ZC-1359-03) requiring recording perpetual cross access, ingress/egress, and parking easements with the property to the east on 1.5 acres in an M-1 (Light Manufacturing) (AE-70) Zone. Generally located on southeast corner of Martin Avenue and Schuster Street within Enterprise

 

This is well designed project and nice addition to the area.  The cross access is not required for the tavern being built next door.  BCC morning consent Item #3

 

13.       DR-1013-07 — YARAN, LLC:         TAB held, no applicant:  Companion item 19

 

DESIGN REVIEW for a shopping center on 10.0 acres in a C-2 (General Commercial)Zone in the Pinnacle Peaks Concept Plan area. Generally located on the southeast corner of Rainbow Boulevard and Mardon Avenue within Enterprise  BCC morning consent Item # 4

 

14.       DR-1016-07 — RAINBOW STRUCTURES, LLC: TAB Approved

 

DESIGN REVIEW for a shopping center on 3.8 acres in a C-2 (General Commercial) Zone. Generally located on the southwest corner of Rainbow Boulevard and Windmill Lane within Enterprise.

 

The plans depict a shopping center consisting of 5 single-story buildings with a total of 41,155 square feet. A variety of roof types, including parapet and hip roofs, will vary in height up to a maximum of 28 feet. The exteriors of the buildings will feature stucco walls in various earth tones and stone veneered columns. Green aluminum trellises and green standing seam metal roofs provide additional architectural detailing. Access to the site is via one driveway on Rainbow Boulevard and one driveway on Windmill Lane. A total of 184 parking spaces are being provided where 173 spaces are required. Landscaping exceeding Title 30 standards, including detached sidewalks along both street frontages, is shown throughout the site.  The TAB recommended the applicant consult with METRO about landscaping the western boundary of their property.  METRO is building a substation west of this location and did not want any landscaping along parts of their property. MAJOR PROJECT PUBLIC FACILITIES NEEDS ASSESSMENT to address issues of concern to Clark County for a master planned community (Rhodes Ranch) on approximately 1,548.0 acres in various zoning districts. Generally located on the west side of Durango Drive between the 215 Beltway and Pebble Road within Spring Valley and Enterprise  BCC morning consent Item # 12

 

18.       ZC-0515-07 (WC-0280-07) — CACTUS RUSH 35, LLC: TAB Approved

 

WAIVER OF CONDITIONS to construct full off-sites (excluding paving) on 4.7 acres in a C-1 (Local Business) Zone. Generally located on the north side of Cactus Avenue, 300 feet west of Polaris Street within Enterprise.

                                                                                                           

This applicant has worked with residents to the east of their property on all aspects of the project.  The waiver will allow the applicant to match the road already in place for the residential property to the east.  BCC afternoon Item # 28

 

19.       WT-1015-07 — YARAN, LLC:   TAB held, no applicant:  Companion item 13

20.       ZC-1034-07 — WARM JONES, LLC: TAB Approved: The zone district was reduced to R-3 with Public Design review required

 

ZONE CHANGE to reclassify 15.4 acres from R-E (Rural Estates Residential) Zone to R-4 (Multiple Family Residential- High Density) Zone for a future development in the MUD-3 and CMA Design Overlay Districts. Generally located on the north side of Warm Springs Road and the west side Bronco Street (alignment) within Enterprise (description on file).

 

The TAB has not looked favorably upon zone change requests with no plans.  State law does not allow the zone change to be denied.  However, the lowest zone district within the land use category will satisfy the state law requirements.  The TAB has started using the least dense zone district available and requiring a public design review.  BCC morning consent Item # 18
