1.      DR-0481-13 – GALLERY 2012, LLC:

APPROVED per staff conditions

DESIGN REVIEW for a mixed use development consisting of residential and commercial uses in a hillside transition area on 18.4 acres in a U-V (Urban Village - Mixed Use) Zone in the MUD-4 Overlay District.  Generally located on the north side of Blue Diamond Road and the east side of Buffalo Drive within Enterprise.  SB/jt/ml  (For possible action)

 

This application is to review the impact of an approved mixed use development to a natural hillside that is located within 660 feet to the south of the subject site, across Blue Diamond Road.

 

The design of this project was previously approved with ADR-0873-12, and the final grading plan, which was submitted with this application, was approved by the Clark County Department of Public Works under HTE-13-11689. This application is to satisfy a requirement of Title 30 that all development within the transition area, which is defined as any area within 660 feet of hillside that contains at least 2.5 acres of continuous slopes in excess of 12%, submit for a design review as a public hearing.

 

The TAB determined that this project will not affect the hillside area.

 

2.      UC-0475-13 – REAL EQUITIES, LLC:

APPROVED per staff conditions

USE PERMITS for the following:

 

1) An on-premise consumption of alcohol establishment (tavern); and

2) Reduced separation from a tavern to a residential use

 

in conjunction with an existing shopping center on 28.7 acres in an H-1 (Limited Resort and Apartment) Zone in the MUD-1 Overlay District.  Generally located on the northwest corner of Serene Avenue and Las Vegas Boulevard South within Enterprise.  ss/pb/ml  (For possible action)

 

This site was occupied by Stoney’s Rocking Country until they moved to Town Square.  The use permit for Stoney’s has expired because they did not comply with the 1 year to review condition.  The result is a new use permit is required for the Rubicon Club and Grill.  The staff has not found any complaints for the operation of Stoney’s. 

 

The Rubicon Club and Grill will operate in the same location as Stoney’s with the same conditions.

 

3.      VS-0471-13 – ROOHANI KHUSROW FAMILY TRUST, ET AL:

APPROVED per staff conditions

Change Public Works bullet #2 to read:

   Right-of-way dedication to include 45 feet to back of curb for Silverado Ranch Boulevard and 35 feet to back of curb for Lindell Road and 30 feet dedication for Gary Avenue right-of-way.

 

VACATE AND ABANDON easements of interest to Clark County located between Richmar Avenue and Silverado Ranch Boulevard, and between Lindell Road and Edmond Street (alignment) in an R-E (Rural Estates Residential) Zone within Enterprise (description on file).  SB/co/ed  (For possible action)

 

The TAB on a previous application recommended the dedication for 30 feet of right-of-way for Gary Ave.

If the elementary school site is moved to the north the Gary Ave dedication is of greater importance.

 

This application is effected by ZC-0467-13 and TM-0127-13 on the BCC September, 18, 2013 agenda.

4.      WS-2148-04 (WC-0081-13) – SBH LOT OPTION, LLC:

DENIED per staff if approved conditions

 

WAIVER OF CONDITIONS of a waiver of development standards for a single family subdivision requiring Lots 100 through 105 having rear yards between 19.5 feet to 23.5 feet with landscaping in the rear yards on 0.1 acres in an R-3 (Multiple Family Residential) Zone in the MUD-4 Overlay District.  Generally located on the northeast corner of Tom Sawyer Street and Wuthering Heights Avenue within Enterprise.  SB/jt/ml  (For possible action)

 

This application applies to lot 100 only.  North of this property is RNP-1.  The buffering for the RNP-1 has changed since this application was approved; 10,000 sq. ft. is the current standard.  The original application required a greater rear yard setback do to the location next to the RNP-1.  The TAB opinion is the desire for a larger house in not sufficient reason to decrease the negotiated set back.

 

The applicant stated they have a house product that will fit on the property and meets the setback requirements.

 

5.      WS-0489-13 – SBH LOT OPTION, LLC:

DENIED per staff if approved conditions

 

WAIVER OF DEVELOPMENT STANDARDS to reduce rear yard setbacks in conjunction with an existing single family subdivision on 0.1 acres in an R-3 (Multiple Family Residential) Zone in the MUD-4 Overlay District.  Generally located on the north side of Wuthering Heights Avenue, 65 feet east of Black Beauty Street (alignment) within Enterprise.  SB/jt/ml  (For possible action)

 

This application is for lots 107 and 108.  The setback for these was previously reduced from 15 feet to 9.5 feet.  The TAB felt a further reduction is not appropriate and could generate additional waivers from the future homeowners.

 

09/18/13 BCC

 

6.      UC-0271-11 (ET-0073-13) – ROJUSA, LLC:

APPROVED per staff conditions

 

USE PERMIT FIRST EXTENSION OF TIME to reduce the setback from a service station to a residential use.

 

DESIGN REVIEW for a convenience store/service station and a car wash facility on a portion of 1.8 acres in a C-2 (General Commercial ) (AE-60) Zone.  Generally located on the east side of Decatur Boulevard and the north side of Silverado Ranch Boulevard within Enterprise.  SB/co/ml  (For possible action)

 

The applicant was a no show for the second time.  The applicant was granted a building permit one day before the use permit expired.  They have commenced construction on August 6, 2013.

 

Normally, the TAB would request the application be sent back until the applicant could appear.  In this case, because the construction has started the TAB approved the use permit and forwarded it to the BCC for their action.

 

7.      ZC-0736-09 (ET-0074-13) - NEVADA SENIOR HOLDINGS, LLC:

APPROVED per staff conditions

 

ZONE CHANGE SECOND EXTENSION OF TIME to reclassify 5.2 acres from R-E (Rural Estates Residential) Zone and C-2 (Commercial General) Zone to U-V (Urban Village – Mixed Use) Zone in the MUD-4 Overlay District for a mixed use development.

 

USE PERMITS for the following:

 

1) A congregate care facility; and

2) Increase building height.

 

DESIGN REVIEWS for the following:

 

1) a mixed use development consisting of residential, congregate care, commercial, and open space; and

2) a manmade decorative water feature. 

 

Generally located on the north side of Jeffreys Street/Ione Road, 500 feet west of Eastern Avenue within Enterprise (description on file).  SS/bk/ml  (For possible action)

 

The applicant is negating a lease with a health care provider.  Once the lease is in place, bank financing will be available for the property.

 

ADDITIONAL BUSINESS

 

TAB to consider recommendation for a change to Title 30.52.080.d.2 Improvement Requirements for a Minor Subdivision. (for possible action)

 

Traffic Committee will propose an RTC study using Common Street Concept for the rural roads.  This is in place of individual changes to Title 30.
